By participating in the Game, each player agrees to be bound by the rules of the Game and the following terms and conditions.

Risk Disclosure

The trading limit and available cash granted to each player are only virtual sums. They cannot be withdrawn and are non-exchangeable.

As far as possible, the system is designed to simulate a real-world trading system. However, in reality, equities trading involves risks such as price fluctuation, suspension or restriction of trading etc. In light of the risks, you should undertake such transactions only if you understand the nature of securities, including derivatives and contracts (and contractual relationship) which you are entering into objectives, financial resources, and other relevant circumstances. If in any doubt, you should seek professional advice. Different securities involve different levels of risk and in considering whether to trade in securities, the players should be aware of the risks involved in real-world stock trading.

Qualifying Participants

Phillip Participants must be at least 18 years old or above, can be of any nationality and must be residing in Singapore. Each contestant is allowed to participate under the “Individual” category. Participants can be students from any of the participating universities (SIM, NUS, NTU & SMU) or students from graduating class for the year 2009.

Prizes, Winner Notification and Release

PSPL reserves the right to vary any cash prize amount or substitute them with equivalent prizes.

Failure to comply with any terms or conditions (including the eligibility requirements) or the rules of the Game may result in a winner’s disqualification, the forfeiture of his/her interest in the prize, and the award of the prize to an alternate winner.

Winners will be notified by PSPL and results will be posted on http://shares.poems.com.sg.

All winners will have to produce their tertiary pass to claim their prizes. All participants who win a prize must agree to allow their name and photograph be used in public communication mediums such as, but not limited to, newspapers, internet or television, without limitation or compensation.

Marketing Materials

By completing the registration details, each player agrees to receive marketing materials from PSPL.

Decisions of PSPL to be Final

All decisions made by PSPL regarding any aspect of the Game shall be deemed final.

No warranties for contents

Although best efforts have been used to ensure that the information set out on the website is reliable or reproduced from sources which Phillip Securities believe to be reliable as at the date of publication, no warranty is made as to its accuracy, completeness and adequacy. Phillip Securities have no obligation to update, modify or amend website to correct any inaccuracy which subsequently becomes apparent.

Changes to the website

PSPL reserves the right to partly or completely change the website at any time, and to restrict, interrupt or terminate its service, without notice. If the Game is terminated prior to the stated expiration date, PSPL reserves the right to award prizes based on the entries received before the termination date.

Copyright and Trademark

Except where expressly stated, PSPL owns all the intellectual property rights in all the contents and design of the website, flyers, posters, banners and other collaterals and any logos or trademarks displayed on the website, flyers, posters, banners and other collaterals. You may use the materials on the website, flyers, posters, banners and other collaterals for your personal and non-commercial reference only. You may not reproduce, republish, distribute, translate, transmit, display, broadcast or otherwise exploit any materials on the website, flyers, posters, banners and other collaterals, or use any logos or trademarks displayed on the website, flyers, posters, banners and other collaterals, without the prior written consent of PSPL and/or relevant third party owner of intellectual property rights

Safety of Communication

Communications over the Internet and by email cannot be guaranteed to be secure. There is a risk such communications may be intercepted, lost, destroyed or delayed in transmission. Although PHILLIP SECURITIES PTE LTD will use reasonable efforts to minimize such risks, they do not warrant that any communication or email or any attachments will be free of viruses, worms or other harmful components.

Governing Law and Jurisdiction

These terms and conditions are exclusively governed by and shall be construed in accordance with Singapore law.

Each player is subject to the exclusive jurisdiction of the courts of Singapore in respect of any disputes arising under these terms and conditions.

Severability

If at any time any provision (or part of any provision) of these terms and conditions is, or becomes, illegal, invalid or unenforceable in any respect under the law of any jurisdiction, that shall not affect the legality, validity or enforceability in that or any other jurisdiction of any other provision (or any other part of this provision) of these terms and conditions.
